Jury sides with doctors in case of alleged negligence

November 3, 2023 -- A jury has decided in favor of two doctors -- one of whom is a radiologist -- who were charged in a medical negligence and wrongful death case, according to a local media report.

Dr. Peter Knabe, a radiologist with Lima Radiological Associates in Lima, and Stephen Justice, MD, a family practice doctor with Wilson Health in Sidney, Ohio, U.S., were charged in a case regarding the care of Bobby Jackson, who died of lung cancer in 2017, the article noted.

Knabe was charged with negligence in reading a CT scan performed on 2 August 2015 in a Wilson Health emergency department, while Justice was charged with negligence for not referring Jackson for a CT scan follow-up during an appointment on 11 August 2015. The jury returned a verdict that neither Knabe nor Justice was negligent in Jackson’s care.

In addition, the doctors were cleared of a “loss of consortium” claim, a legal term referring to the deprivation of the benefits of a family relationship due to injuries or death -- in this case the loss of Jackson as a husband, father, and grandfather, according to the article.
